The Member of Parliament for Okaikwei Central, Hon. Patrick Yaw Boamah, says credit for Ghana's victory in the US$400 million tax arbitration against Tullow Ghana Limited must go to former Attorney-General, Godfred Yeboah Dame.
His comment follows a press release dated 30th September 2026 by Finance Minister, Dr. Cassiel Ato Forson, titled "Statement of Ghana's Victory in the Tullow Tax Arbitration."
In a statement responding to the Finance Minister, Hon. Boamah said he notes with satisfaction the dismissal of the arbitral proceedings instituted by Tullow at the ICC International Court of Arbitration, but that a substantial part of the arbitration was conducted under the stewardship of the former A-G.
According to him, most of the procedural steps were taken before 2025, including the filing of the arbitration, filing of Ghana's responses, composition of the tribunal, challenge of arbitrators, appointment of lawyers and filing of witness statements.
He recounted that Tullow filed its Request for Arbitration in February 2023 and nominated Mr Alistair Schaff KC as its arbitrator, while in April 2023, Ghana filed its Response, raised a counterclaim, nominated Mr Christopher Thomas KC as its arbitrator and objected to Tullow's nominee.
"The ICC Secretariat upheld Ghana's objection and, on 4th May, 2023, invited Tullow to nominate a new co-arbitrator by 18th May, 2023. Tullow complied on that date and appointed Dr Michael Pryles AO PBM as its new arbitrator," he stated.
Hon. Boamah further indicated that in May 2023, the Attorney-General appointed Foley Hoag LLP, a Washington-based law firm, to act for Ghana and confirmed the appointment to the Tribunal in November 2023.
He said Tullow filed its Reply to Ghana's Counterclaim in June 2023, and after numerous procedural steps, formally filed its Statement of Claim in May 2024 together with three witness statements, while Ghana responded in September 2024 with its Statement of Defence supported by four witnesses - Mr William Kofi Demitia, Dr Martin Kolbil Yamborigya, Dr Justice Yaw Ofori and Mr Stephen Midwinter.
"In January, 2025, Tullow filed its Reply to Ghana's Statement of Defence and Counterclaim, setting the stage for the trial to proceed," he added.
Hon. Boamah said he had taken pains to set out the history to illustrate the work done by the former Attorney-General to set Ghana on the course to victory, and that as a nation "we should give credit where it is due."
