The High Court in Accra has adjourned the bail application of Salomey Baffoe, who is accused of abetting social media personality Ghana Jollof in the publication of false information, to September 24.
The adjournment came after the prosecution asked for more time to respond to the bail application.
Assistant State Attorney, Carl Afedzi Forson, told the court he was not the substantive lawyer for the case and that the Attorney-General’s Office was only served with the bail application on Friday.
He said Monday was a public holiday and the application had not yet been assigned to a lawyer, and therefore prayed for a short adjournment.
But counsel for Baffoe, Nana Agyei Baffour Awuah, opposed the request, arguing that the liberty of his client was at stake and should not be treated like a civil case that requires three clear days for service.
He said there was proof of service and the State had not complained of being short-served. He added that applications concerning liberty can be heard even on weekends and that the State had had enough time to respond.
He warned that further delay could make the application moot, as Baffoe would have spent two weeks in custody by the time the prosecution files its response.
The court, in its ruling, noted that the liberty of the applicant was at stake and the State could not take the matter for granted.
It subsequently adjourned the case to September 24 and directed the Republic to file and serve any processes it intends to rely on by 9:00 a.m.
