Ofoase-Ayirebi MP, Kojo Oppong Nkrumah, says he is considering asking the Supreme Court to review its decision after the court dismissed his application to block selected High Court judges from hearing criminal cases during the legal vacation.
The injunction was meant to challenge a warrant issued by the Chief Justice authorizing the judges to sit during the break.
Speaking to journalists after the ruling, Mr. Oppong Nkrumah said although the court threw out the application, it made notable comments in its judgment.
“The court has dismissed our injunction application, but in the ruling some very interesting pronouncements have been made,” he said.
He pointed to the court’s admission that certain cases were fast-tracked.
“For the first time, the courts have admitted that some cases have been treated differently. Those are the words of the judge. They have been treated differently and expeditiously. Why? He doesn’t say so,” the MP stated.
Despite acknowledging the different treatment, the court ruled that it did not breach the constitutional provisions cited in the case.
“But then he proceeds to say that, in his opinion, that will not amount to a violation of the constitutional articles that we have raised in this particular matter and that he thinks that will even be in the interest of the accused persons,” Mr. Oppong Nkrumah explained.
He said his lawyers have applied for a certified copy of the ruling to study it closely before deciding what to do next.
“We’ve asked for a certified copy so that we can peruse it some more and then on the advice of counsel we’ll take the next steps,” he added.
When asked directly if he would pursue a review, the MP replied: “Very much so, very much so, but we’ll consider it.”
