US Court Grants Ken Ofori-Atta Green Card Despite Ghana Cases

A US immigration court has approved former Finance Minister Ken Ofori-Atta’s application to adjust his status, moving him closer to permanent residency in America.
The ruling came Monday after the judge reviewed his I-485 petition. According to his lawyer, Frank Davies, the court also looked into the criminal cases Ofori-Atta faces in Ghana.
During the hearing, the judge reportedly questioned how Ghana’s Office of the Special Prosecutor handled aspects of the matter. The court heard that the OSP had declared Ofori-Atta a fugitive while he was undergoing medical treatment in the US and his lawyers were still in contact with investigators back home.
A witness with knowledge of Interpol processes also raised concerns about the procedures Ghanaian authorities used to pursue him.
Ofori-Atta still faces several criminal charges in Ghana tied to his time as Finance Minister. The charges include alleged financial losses of over GH¢1.4 billion linked to a contract with Strategic Mobilisation Limited.
The OSP opened an investigation in June 2025 and sought an Interpol Red Notice after he missed multiple invitations to appear for questioning. Interpol later removed the notice.
Legal analysts say the US decision doesn’t affect the cases pending in Ghana. Those matters remain before Ghanaian courts. But the ruling could complicate any future efforts by Ghana to bring Ofori-Atta back to face trial.
